AMOS Terms of Service

The short version

  • AMOS is a membership. There's no retainer and no lock-in, and you can cancel any time.
  • You keep ownership of your data and your content. We use it only to run your account, as described in our Privacy Policy.
  • AMOS suggests changes. Nothing is published to Amazon, Meta or any other channel unless you, or our team acting on your request, chooses to publish it.
  • Recommendations, forecasts and AI drafts are estimates, not guarantees.
  • Use AMOS lawfully and within the rules of the marketplaces you sell on.

1. Who we are and agreement to these terms

AMOS is a software platform and service operated by NWCG, doing business as AMOS ("AMOS", "we", "us"), based in Bellevue, Washington, USA. Contact: info@nwcommercegroup.com.

These Terms of Service ("Terms") apply to the AMOS web app, the marketing site at amos-co.com, and any services you order through AMOS. By creating an account, signing in, or using AMOS, you agree to these Terms on behalf of yourself and the business you represent. If you don't agree, don't use AMOS.

2. Accounts

  • You must be at least 18 and authorized to act for the business that holds the account.
  • The account owner (primary contact) is responsible for the account, its billing, and the team members they invite.
  • Keep your sign-in details secure and tell us promptly at info@nwcommercegroup.com if you think your account has been accessed without permission.
  • Information you give us must be accurate and kept up to date.

3. Membership, billing and cancellation

  • Plans. AMOS is offered as a monthly or annual membership at the price shown when you sign up or renew.
  • Renewal. Memberships renew automatically at the end of each billing period until cancelled.
  • Cancel any time. The account owner can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then. We don't charge cancellation fees.
  • Refunds. Membership fees already paid are not refunded for partial periods, unless required by law or we agree otherwise in writing.
  • Failed payments. If a payment fails, we retry for a short grace period. If it still isn't paid, access to the account may be paused until the balance is settled.
  • Services. Some services are ordered separately at the price and estimated turnaround shown when you order. Turnaround times are estimates. Members on certain plans may receive a discount on services, as shown at the time of ordering.
  • Price changes. We'll give you at least 30 days' notice before a price change applies to your membership. The change takes effect at your next renewal after that notice.
  • Taxes. Prices don't include taxes unless stated. You're responsible for any applicable taxes.
  • Payment processing. Payments are processed by our payment provider. We don't see or store your full card number.

4. Connected accounts

AMOS can connect to third-party platforms such as Amazon Seller Central, Amazon Ads and Meta, with your authorization.

  • You confirm you're allowed to connect each account and to grant AMOS the access you approve.
  • You can disconnect a platform at any time, from AMOS or from that platform's own settings.
  • Your use of those platforms is still governed by their own terms and policies. We aren't responsible for their availability, changes to their APIs, or decisions they make about your account.

5. Your data and content

  • You own it. You keep all rights to your business data, product information, images, files and messages ("Your Content").
  • Our permission to use it. You give us a limited permission to store, process and display Your Content only as needed to provide AMOS to you, deliver services you order, and keep AMOS secure.
  • Privacy. How we collect, use, keep and delete data is set out in our Privacy Policy. You can request deletion at any time through our Data deletion page.
  • Aggregated data. We may use aggregated, de-identified information that can't identify you or your business to operate and improve AMOS.
  • Your responsibility. You're responsible for Your Content, including making sure you have the rights to the images, text and claims you upload or approve, and that product claims are accurate.

6. Recommendations, AI and publishing

  • AMOS produces recommendations, scores, alerts, forecasts and AI-assisted drafts (such as listing copy, images and ad concepts) based on the data available to it.
  • These are estimates and suggestions. They may be incomplete or wrong, and results depend on many factors outside our control, including marketplace algorithms, competitors and demand.
  • You decide what to act on. AMOS doesn't publish changes to Amazon, Meta or other channels on its own; publishing happens only when you, or our team acting on your request, chooses to publish.
  • Review AI-generated content before you use it, including for accuracy, compliance with marketplace rules, and third-party rights.

7. Acceptable use

You agree not to:

  • use AMOS in breach of any law, or of the terms and policies of Amazon, Meta or any other connected platform;
  • upload content that infringes someone else's rights, or that is unlawful, misleading or harmful;
  • upload personal information about shoppers or other individuals that AMOS doesn't need;
  • try to access accounts or data that aren't yours, or probe, disrupt or overload AMOS;
  • copy, resell, reverse-engineer or build a competing product from AMOS, except as allowed by law;
  • share your sign-in with people outside your business, or use AMOS to provide a service to third parties without our written agreement.

We may suspend access if we reasonably believe these rules are being broken, and we'll tell you why unless we're not allowed to.

8. Our intellectual property

AMOS, including its software, design, scoring methods, playbooks, templates and branding, belongs to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use AMOS for your business while your membership is active. Feedback you send us may be used to improve AMOS without obligation to you.

9. Availability and changes to AMOS

We work to keep AMOS available and reliable, but it may sometimes be unavailable for maintenance, updates, or reasons outside our control. We may add, change or remove features. If we remove a feature that's central to your plan, we'll tell you in advance where we can.

10. Disclaimers

AMOS is provided "as is" and "as available". To the extent allowed by law, we don't make warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee any specific sales, ranking, advertising or financial result.

11. Limitation of liability

To the extent allowed by law:

  • neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible;
  • our total liability for any claim relating to AMOS is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.

Nothing in these Terms limits liability that can't be limited by law.

12. Indemnity

You'll defend and indemnify us against third-party claims arising from Your Content, your use of connected platforms, or your breach of these Terms or the law.

13. Ending your account

  • You can stop using AMOS and cancel at any time (Section 3).
  • We may suspend or end your account if you seriously or repeatedly break these Terms, if payment isn't made, or if required by law.
  • When an account ends, your data is handled as set out in the Privacy Policy, including its deletion schedule.
  • Sections that by their nature should continue (such as ownership, disclaimers, limitation of liability and governing law) continue after your account ends.

14. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules. Before starting a formal dispute, please contact us at info@nwcommercegroup.com so we can try to resolve it informally. Any dispute that isn't resolved informally will be heard in the state or federal courts located in King County, Washington, and both parties agree to that jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll notify the account owner by email or in AMOS at least 30 days before it takes effect. Continuing to use AMOS after the change takes effect means you accept the updated Terms.

16. General

  • These Terms, together with the Privacy Policy and any order you place, are the whole agreement between you and us about AMOS.
  • If any part is found unenforceable, the rest stays in effect.
  • Not enforcing a right isn't a waiver of it.
  • You may not transfer your account without our written consent. We may transfer these Terms as part of a merger, acquisition or sale of assets.
  • Neither party is responsible for delays caused by events outside its reasonable control.
